Terms of Service
TL;DR: Use Callora for legitimate business calls. Don’t break the law with it. We’ll do our best to keep it running. If we screw up, you get your money back for that period. That’s the whole deal.
1. Acceptance
By creating an account or making a call with Callora you accept these Terms. If you’re accepting on behalf of a company, you represent you have authority to bind that company.
2. The service
These master Terms cover both products in the Callora suite: Callora (AI voice-agent API + dashboard at call.metis.gold/callora) and Medora (AI locum tenens recruiting product at call.metis.gold/medora). Medora buyers should read this alongside the Medora addendum and Medora privacy notice. We may change features with reasonable notice.
3. Your account
- You must be at least 16 years old (18 in some jurisdictions).
- You are responsible for keeping your credentials secure and for all activity under your account.
- One user per account. Teams should use workspaces (Business tier).
4. Acceptable use
You will not use Callora to:
- Violate the U.S. Telephone Consumer Protection Act (TCPA), the FCC’s Do-Not-Call rules, CAN-SPAM, the UK PECR, GDPR, or any local telecom law.
- Impersonate another person or entity, including generating a voice designed to mimic a specific real human without that person’s consent.
- Commit fraud, phishing (“vishing”), scams, or social engineering.
- Harass, threaten, or defame any person.
- Generate deepfakes intended to deceive, including election-related deepfakes prohibited by U.S. or EU AI-Act rules.
- Provide medical, legal, or financial advice without appropriate professional oversight and disclaimers.
- Attempt to reverse-engineer, scrape, or bypass rate limits, security, or paywalls.
- Store or transmit malware, unlawful content, CSAM, or content that infringes IP rights.
We may suspend or terminate accounts violating these rules without notice.
5. Consent for recording and monitoring
You are responsible for obtaining any legally required consent from callers you contact or record. Many jurisdictions require two-party (all-party) consent. Callora provides opening-message and recording-notification tools — use them. We will suspend accounts making campaigns without documented consent to called-party lists.
6. Pricing, billing, refunds
- Plans are billed monthly in advance in the currency shown at checkout.
- Overage is billed monthly in arrears at the rates published on the pricing page.
- You can cancel at any time from Dashboard → Billing. Cancellation takes effect at the end of the current billing cycle.
- All fees are non-refundable except (a) as required by law, or (b) if we materially breach these Terms and fail to cure within 30 days of your written notice.
- Chargebacks without prior contact to billing@call.metis.gold may result in permanent account suspension.
7. Your content
You retain all rights to agent configurations, knowledge-base content, call recordings, and transcripts you generate. You grant Callora a limited, worldwide, non-exclusive license to store, transmit, and process this content solely to operate the service. We do not use your content to train foundation models. OpenAI’s API terms similarly disable training on our data.
8. Our IP
Callora, Metis Gold, all logos, software, and documentation are our IP. We grant you a limited, non-transferable, revocable right to use the service per these Terms.
9. Availability and SLA
- Free / Pro tiers: no formal SLA. We target 99.9% availability but do not underwrite it financially.
- Callora Business tier and Medora Locum Pro / Agency: 99.9% monthly uptime SLA. If we miss it, you receive service credits per the enterprise addendum available on request.
- Scheduled maintenance windows are announced at /trust or via status page at least 24 hours in advance.
10. Warranties and disclaimers
The service is provided “as is” and “as available.” We disclaim all warranties, express or implied, to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.
AI outputs may be inaccurate. You are responsible for reviewing outputs before acting on them. Voice AI is not certified for use in life-safety, aviation, nuclear, or emergency-response contexts.
11. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, consequential, incidental, special, or punitive damages, or for lost profits or lost data.
- Each party’s aggregate liability is capped at the greater of (a) fees paid to Callora in the 12 months before the claim, or (b) US$100.
12. Indemnification
You will defend and indemnify Callora against third-party claims arising from your content, your acceptable-use violations, or your violation of law (including TCPA violations from your outbound calls). Callora will defend and indemnify you against third-party claims that our service, when used as permitted, infringes their IP rights.
13. Suspension and termination
Either party may terminate for material breach after 30 days’ written notice and opportunity to cure. We may suspend without notice for security, fraud, or acceptable-use violations. On termination we retain data per our Privacy Policy retention windows; you can export data during your final billing cycle.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware (or, if you are an EU consumer, your country of residence for consumer-protection purposes). Disputes will be resolved in the state or federal courts of Delaware (or your local courts as an EU consumer), except that either party may seek injunctive relief in any court of competent jurisdiction for IP or security violations.
15. Miscellaneous
- Force majeure: neither party is liable for delays caused by events outside reasonable control.
- Assignment: you may not assign these Terms without our consent (except in connection with a merger); we may assign to an affiliate or successor.
- Entire agreement: these Terms + the Privacy Policy + any executed Order Form supersede prior agreements.
